By accessing our website, making a reservation, making a payment, checking in, or using any service or facility provided by Water View Residency, you acknowledge that you have read, understood, and agreed to these Terms & Conditions.

Please read these terms carefully before making a reservation.

1. General

These Terms & Conditions apply to all guests, visitors, customers, and users of the Water View Residency website and property.

Water View Residency reserves the right to update, modify, or amend these Terms & Conditions from time to time. The latest version published on this page will apply to future bookings and stays, subject to applicable law and any specific terms already agreed for a confirmed booking.

2. Reservations and Bookings

• All reservations are subject to room availability and confirmation by Water View Residency.
• Guests must provide accurate and complete information while making a reservation, including their name, contact number, email address, number of guests, dates of stay, and any other information requested during the booking process.
• A reservation shall be considered confirmed only after confirmation by Water View Residency and/or receipt of the required advance payment, as applicable to the selected rate or booking plan.
• Water View Residency reserves the right to refuse, cancel, or modify a reservation where incorrect, incomplete, fraudulent, misleading, or unauthorised information has been provided.
• Special requests, room preferences, early check-in, late check-out, additional guests, and other requests are subject to availability and are not guaranteed unless expressly confirmed by the property.

3. Check-In and Check-Out

• Standard check-in and check-out timings will be communicated during the booking process or by the property.
• Guests are required to complete the applicable check-in formalities before occupying a room.
• Early check-in is subject to room availability and may attract additional charges.
• Late check-out is subject to availability and may attract additional charges.
• The property reserves the right to decline early check-in or late check-out requests depending on operational requirements.
• Guests may be required to vacate the room at the designated check-out time unless an extension has been approved by the property.

4. Guest Identification and Registration

• All guests must provide valid government-issued photo identification at check-in, as required by applicable law and hotel procedures.
• Foreign nationals may be required to provide additional travel or identification documents as required under applicable Indian laws and regulations.
• The name and details provided at the time of check-in must correspond with the applicable booking and identification documents.
• Water View Residency reserves the right to refuse check-in where legally required identification or documentation is not provided.
• Additional guest-registration requirements may apply depending on the nature of the booking and applicable regulations.

5. Room Occupancy and Additional Guests

• Maximum occupancy for each room is determined by the room category and booking conditions.
• Guests must not exceed the permitted occupancy of the booked room without prior approval from the property.
• Additional guests, extra beds, mattresses, meals, or other services may attract additional charges.
• Children and additional-guest policies may vary depending on the room category and rate plan.
• Guests should confirm applicable occupancy and additional-person charges before completing their reservation.

6. Tariffs, Taxes and Payments

• Room rates and service charges may vary depending on dates, room category, availability, rate plan, offers, and promotional conditions.
• Applicable taxes, government levies, and other mandatory charges will be payable in addition to the displayed room rate unless expressly stated otherwise.
• Water View Residency reserves the right to change published rates before a reservation is confirmed.
• Once a booking has been confirmed, the applicable rate and payment conditions communicated for that booking will apply, subject to the terms of the selected rate plan.
• Full or partial advance payment may be required to confirm a reservation.
• Any outstanding balance must be settled according to the payment terms communicated by the property.

7. Advance Payments and Non-Refundable Bookings

• Where a booking is specifically identified as non-refundable, any advance amount paid to confirm that booking will generally not be refundable in the event of cancellation, no-show, early departure, or change of travel plans.
• The refundability of an advance payment will depend on the specific rate plan, booking terms, offer, package, or promotional conditions applicable to the reservation.
• Guests should carefully review the applicable booking conditions before making payment.

8. Cancellation, Modification and Refunds

• Cancellation, modification, and refund conditions may differ according to the selected room rate, booking channel, package, promotional offer, or special booking terms.
• The cancellation policy applicable to a confirmed reservation will be the policy communicated at the time of booking.
• Cancellation requests should be made through the booking channel or contact method specified by Water View Residency.
• No-show reservations may be treated as cancellations and may be subject to applicable charges.
• Early departure from the property may not automatically qualify for a refund.
• Refund processing, where applicable, may take additional time depending on the payment method or financial institution involved.
• Guests are advised to review the separate Cancellation & Refund Policy before completing a reservation.

9. Pool and Recreational Facilities

• Access to the rooftop swimming pool and other recreational facilities is subject to property rules, operational availability, maintenance requirements, weather conditions, safety considerations, and management discretion.
• Pool access timings may change from time to time and will be communicated by the property or displayed at the relevant facility.
• Guests must comply with all pool safety instructions, hygiene requirements, age restrictions, supervision requirements, and other rules displayed or communicated by the property.
• Children must be appropriately supervised by a responsible adult where required.
• The property may temporarily restrict or suspend pool access for maintenance, private events, adverse weather, safety concerns, hygiene reasons, or other operational requirements.
• Pool access may be subject to the terms of the applicable booking or package.

10. Visitor / Non-Resident Guest Policy

• Visitors who are not registered guests of Water View Residency may visit the property only during the permitted visitor hours.
• All visitors must leave the property by 10:00 PM.
• Visitors are not permitted to remain on the property after 10:00 PM unless they are properly registered as overnight guests in accordance with the property’s check-in and identification requirements.
• All visitors may be required to provide valid government-issued photo identification and register their details at the property before entering, as required by hotel policy or applicable law.
• The registered guest is responsible for the conduct and behaviour of their visitors during their visit.
• Visitors are required to comply with all hotel rules, safety requirements, and facility-specific policies.
• Access to guest rooms, rooftop areas, swimming pool, dining areas, banquet facilities, or other hotel facilities may be restricted for visitors unless specifically permitted by the property.
• The property reserves the right to refuse visitor entry or ask a visitor to leave where their presence, behaviour, or conduct is considered unsafe, disruptive, unlawful, or contrary to hotel policy.
• Water View Residency reserves the right to modify visitor access rules, timings, registration requirements, or facility access based on operational, security, safety, or regulatory requirements.
• No visitor shall be permitted to stay overnight unless formally registered as a guest and the applicable identification and accommodation requirements have been completed.

11. Guest Conduct

Guests are expected to maintain appropriate standards of behaviour throughout the property.

Guests must not:

• Engage in illegal activities.
• Threaten, abuse, harass, or intimidate hotel employees, other guests, visitors, or service providers.
• Create excessive noise or disturbance.
• Damage, misuse, remove, or interfere with hotel property or equipment.
• Use hotel facilities in a manner that creates a safety risk.
• Engage in any conduct that violates applicable law or hotel rules.
• Bring prohibited or unlawful items onto the property.

Water View Residency reserves the right to ask a guest or visitor to leave the property immediately where their conduct is considered unsafe, unlawful, abusive, disruptive, or contrary to hotel policies.

In such circumstances, the guest may not be entitled to a refund.

12. Damage to Property

• Guests are responsible for any loss, damage, breakage, or destruction of hotel property caused by their negligence, misuse, intentional acts, or the acts of persons accompanying them.
• Water View Residency may recover the reasonable cost of repairing or replacing damaged property from the responsible guest.
• Where applicable, such charges may be adjusted against a security deposit or other amount held by the property, subject to applicable law.
• Guests should report accidental damage to hotel staff as soon as reasonably possible.

13. Personal Belongings and Valuables

• Guests are responsible for taking reasonable care of their personal belongings and valuables during their stay.
• Valuable items should not be left unattended in rooms, public areas, vehicles, or other parts of the property.
• Guests should use any designated safety or storage facilities provided by the property where appropriate.
• Water View Residency shall not be responsible for loss or damage to personal belongings to the extent permitted by applicable law.
• Any lost-and-found item should be reported to the property as soon as possible.

14. Smoking and Restricted Activities

• Guests must comply with all applicable laws and property rules relating to smoking and the use of tobacco or other restricted substances.
• Smoking is permitted only in areas specifically designated for smoking, where such areas are provided.
• Guests must not engage in activities prohibited by Indian law or by the rules of the property.
• Any violation may result in additional charges, removal from the property, cancellation of the stay, or reporting to the appropriate authorities where required.

15. Children and Minors

• Children must remain under appropriate adult supervision while using hotel facilities, including swimming pools, rooftop areas, stairs, elevators, balconies, and other potentially hazardous areas.
• Parents, guardians, or accompanying adults are responsible for the safety and conduct of minors under their supervision.
• Specific age, occupancy, meal, and accommodation conditions may apply depending on the room category and booking plan.

16. Events, Banquets and Private Functions

Water View Residency may provide banquet, rooftop, event, dining, and private-function facilities subject to separate booking conditions.

• Event bookings are subject to availability and confirmation.
• Capacity restrictions and venue-specific safety requirements must be followed.
• Additional charges may apply for catering, décor, equipment, entertainment, extended hours, cleaning, or other event-related services.
• Event-specific cancellation, advance-payment, damage, and refund terms may apply and will be communicated at the time of booking.

17. Website Use

The Water View Residency website is provided for general information, communication, and booking purposes.

Users must not:

• Attempt unauthorised access to the website or its systems.
• Introduce malicious code, viruses, or harmful material.
• Interfere with the operation or security of the website.
• Copy, reproduce, republish, distribute, or commercially exploit website content without appropriate permission.
• Use the website for fraudulent, unlawful, or misleading purposes.

We may update, modify, suspend, restrict, or discontinue any part of the website or its content without prior notice.

18. Website Information and Availability

21. Force Majeure and Circumstances Beyond Our Control

Water View Residency shall not be responsible for failure, delay, interruption, or inability to provide services where such circumstances arise from events beyond the property’s reasonable control, including but not limited to:

• Severe weather
• Fire
• Flood
• Government restrictions or orders
• Public emergencies
• Civil disturbances
• Acts of terrorism
• Utility or infrastructure failures
• Transportation disruptions
• Internet or telecommunications failures
• Other unforeseen events beyond reasonable control

Where appropriate, the property will make reasonable efforts to communicate significant disruptions to affected guests.

22. Limitation of Liability

To the maximum extent permitted by applicable law, Water View Residency shall not be liable for indirect, incidental, special, or consequential loss arising from:

• Use or inability to use the website;
• Temporary unavailability of hotel facilities;
• Third-party booking or payment platform issues;
• Events outside the reasonable control of the property;
• Loss or damage to personal belongings, except where liability cannot lawfully be excluded or limited.

Nothing in these Terms & Conditions is intended to exclude or limit any liability that cannot legally be excluded or limited under applicable law.

23. Right to Refuse or Terminate a Stay

Water View Residency reserves the right to refuse accommodation, cancel a reservation, or terminate a guest’s stay where permitted by applicable law, including circumstances involving:

• False or misleading booking information;
• Failure to provide required identification;
• Non-payment of applicable charges;
• Serious violation of hotel rules;
• Illegal or unsafe conduct;
• Threatening, abusive, or disruptive behaviour;
• Damage to hotel property;
• Conduct that materially affects the safety, security, or comfort of other guests or staff.

Where a stay is terminated due to a guest’s misconduct or violation of these Terms & Conditions, the guest may not be entitled to a refund, subject to applicable law.

24. Intellectual Property

Unless otherwise stated, content appearing on the Water View Residency website, including text, photographs, graphics, logos, branding, design elements, and other materials, is owned by or used with permission by Water View Residency and is protected by applicable intellectual-property laws.

Unauthorised reproduction, modification, distribution, or commercial use of such content is prohibited.

25. Amendments to These Terms

Water View Residency reserves the right to revise these Terms & Conditions at any time.

Any revised version will be published on this page together with an updated effective date. Guests should review the current version before making a new reservation.

Changes will not affect contractual rights or obligations that have already been expressly confirmed, except where changes are required by applicable law.

26. Governing Law and Jurisdiction

These Terms & Conditions shall be governed by and interpreted in accordance with the applicable laws of India.

Subject to applicable law, disputes arising in connection with these Terms & Conditions, a reservation, or services provided by Water View Residency shall be subject to the jurisdiction of the competent courts in Kolkata, West Bengal.
